Family and Marriage Visas

There are two categories of family visas: Immediate relative and family preference. Depending on an immigrant’s relationship to a U.S. citizen they will fall under one of these two categories and the requirements for obtaining a visa change based on which category they are under.

Immediate Relative Immigrant Visas:
The family members that fall under this category include:

  • Spouse of a U.S. Citizen
  • Unmarried Child of a U.S. Citizen that is Under 21 Years Old
  • Orphan adopted abroad by a U.S. Citizen
  • Parent of a U.S. Citizen that is at least 21 years old

The amount of immediate family visas that can be issued aren’t limited each fiscal year like family preference immigrant visas are.

Family Preference Immigrant Visas
Family preference visas have caps on how many may be issued per fiscal year and family members that are included in this category are:

  • Family First Preference (F1): Unmarried sons and daughters of U.S. citizens, and their minor children. (23,400 issued per fiscal year)
  • Family Second Preference (F2): Spouses, minor children, and unmarried sons and daughters (age 21 and over) of lawful permanent residents. 77% of all visas in this category will go to spouses and children. The remainder of visas will go to unmarried sons and daughters. (114,200 issued per fiscal year)
  • Family Third Preference (F3): Married sons and daughters of U.S. citizens, and their spouses and minor children (23,400 issued per fiscal year)
  • Family Fourth Preference (F4): Brothers and sisters of U.S. citizens, and their spouses and minor children, provided that the U.S. citizens are at least 21 years of age. (65,000 issued per fiscal year)

Our Oakland immigration attorneys have years of experience securing family and marriage visas for our clients and we can help you with the first step of filing a petition and every other step of the way.

Investor Visas

Approximately 140,000 employment-based immigrant visas are made available every fiscal year and investor visas fall under this category. In order to qualify as an immigrant investor an applicant must invest, without borrowing money, at least $1,000,000 (U.S.) in a qualifying commercial enterprise or $500,000 (U.S.) in a high-unemployment or rural area that is considered a targeted employment area. A qualifying investment must, within two years, create full-time jobs for at least 10 U.S. citizens, lawful permanent residents, or other immigrants authorized to work in the U.S. Our Oakland immigration lawyers can help you gain your investor visa and help you understand all of the steps to make sure that you follow the stipulations of an investor visa.
