Registration as Sex Offender
Lifetime registration as a sex offender can ruin a person’s life. Under California Penal Code 290 an individual convicted of most sex crimes is required to register with the local police on their birthday every year for the rest of their life and every time they move to a new city. However, depending on the specifics of your case, a post-conviction remedy may be available to overturn a court order to register as a sex offender. In some instances, a person may have been misinformed of important facts at the time of their plea; in other cases, a certificate of rehabilitation or a motion to vacate a plea can remove the requirement of sex offender registration. If you have been convicted of a sex crime, our attorneys can evaluate the circumstances surrounding your case and discuss the options available to you for avoiding registration as a sex offender. In other cases, circumstances surrounding your conviction may be grounds for an appeal. With most crimes, even murder, if you do your time, get paroled, and complete parole, you are not punished for the rest of your life. This is not true with sex offenders. You can be paying for the rest of your life for even a sexual battery. Call my law offices. We work hard to help you avoid this terrible consequence of registration as a sex offender. Back to top
Internet Posting of Photos, Names, and Addresses
Recent laws will put your photo, address, and crime on the Internet for all to see. Under the guise of protecting the public, zealous lawmakers have made sex offenders the subjects of modern day witch hunts. The posting has no logic to it. Pedophiliac sexual predators are lumped together with one-time teen molesters. The public doesn’t know and the lawmakers don’t care. It’s good politics to throw stones at all sexual offenders. Call my law offices. We fight these witch hunts with all legal ways at our disposal. Don’t wait for some nut to throw a brick through your window. We work hard to help protect you and your family. Back to top
False Allegations
False allegations of sexual offenses often occur. Estranged spouses or ex-girlfriends sometimes make up sexual accusations in order to get back at you or your loved one. We can help diffuse the false accusations by factual investigation and analysis of police reports. Call us if you have been falsely accused. Back to top
Internet Sex Crimes and Police Stings
As if there is not enough crime, police often create more by putting out photos of girls on the internet that encourages men to request lewd photos or send nude photos of themselves. However, in reality there is no girl, and the guy is actually texting and emailing the police, who are pretending to be young girls looking for sex. This police-created crime usually ends with the guy driving to a location to meet an underage girl, who does not exist, only to be arrested by police and charged with attempted child molestation and lifetime sex registration. Back to top
Sexual Assault
Sexual assault cases begin with police officers contacting you and asking for your side of the story. Whatever you do, don’t talk to them. Call us immediately. The police are not your friends. They are not just trying to get the facts. They are trying to convict you. Don’t ruin your life. Call us. If you are a parent and the police want to talk to your son about some girl’s allegations of sexual misconduct at school, don’t let them talk to your child without an attorney. Contact our criminal law firm now for effective sexual battery or statutory rape defense. Police are very skilled at encouraging people to talk. Be polite. Say you’d like to talk to an attorney. Then run, don’t walk, to the nearest phone and call us. If people would follow this simple advice, they could avoid much grief. Back to top
Child Molestation
What is it? Any touching of a minor under the age of 14 with sexual intent. Many cases involve false charges. Children are often influenced to make things up (recall the famous McMartin pre-school case). Kids are influenced by vindictive ex-spouses or by jealous ex-girlfriends. Sometimes kids simply wanting to get attention. If you ever get a hint that you are being accused of this call us- some quick, expert investigation can save the situation. We employ lie detector experts that are persuasive in getting these charges dropped. Some cases involve childhood experimentation where both victim and perpetrator are under the age of 13. If we get involved early, often this type of case can be kept out of court. Some cases involve a step-parent or a grandfather who has no previous record but needs psychological help. We use the most respected experts for psychological evaluations to get these cases dropped. Back to top
Statute of Limitations
Often child molestation charges come out of the distant past. Somebody is having trouble in life and out of the blue allegedly remembers that they were molested 15-20 years ago. The statute of limitations has changed to allow very old sex abuse charges to be resurrected if certain conditions are met. Call us immediately if some charge of sexual misconduct surfaces. Don’t take it lightly because they say it happened 15 years ago. Call us immediately. Back to top
Therapy
Don’t make admissions to therapists about any sexual activity before consulting an attorney. Call our Oakland criminal lawyers. We will explain to you that the therapist may be required to notify the police. Many well-meaning people are told by well-meaning family members to just go to therapy only to find the police knocking on their door. Call us first. Avoid grief, avoid jail, avoid registration, and avoid disgrace. Back to top
Pretext Calls
If you get a call from someone out of the past that wants you to apologize for what you supposedly did years ago, call us. Don’t apologize or talk to the caller. You could be being set up by someone calling from the police station trying to get you to say something that the police could use to support an old charge. Many people faced with such a call give general apologies even though they don’t know what the person is talking about. Call us. We’ll help. Back to top
Minors Ages 14 to 17
Minors ages 14 to 17 as victims present unique problems. Frequently the sex activity is consensual. This is still, of course, a crime (especially if the perpetrator is more than three years older) but should not make a person a sex-offender registrant. The danger of these cases is being in the wrong court with the wrong lawyer can result in unjust sex registration. We are the right lawyers. We can help. Back to top
Defense of Rape and Date Rape Charges
Increasingly common are allegations of rape after what has been a consensual sexual relationship. Don’t let your son be punished because a vindictive ex-girlfriend claims rape. We have extensive experience in defending this frequently charged crime. We have represented professional athletes and members of other professions such as doctors and lawyers accused of this ever-popular false charge. Often Robert Beles and his daughter Anne team up to defend these high-profile cases. Read more about how an Oakland rape attorney can defend your case. Back to top
Child Pornography
One minute you can be surfing the net and the next you can be allegedly committing a crime in the privacy of your own home. Visit the wrong site and the police will be breaking down your door, seizing your computer, and searching the hard drive for all of the sites you have ever visited, looking for suspected “child pornography.” Simple downloading of images can bring a mandatory 5 years in the Federal penitentiary. Call us to prevent this disaster. We are frequently able to prevent prosecution altogether when clients bring investigations to our attention in time. If necessary, we hire computer experts to analyze the strength of a case and plan effective defense strategies accordingly. See our Sex Offenses Information Center – Change in Child Pornography Guidelines.
Prostitution and Solicitation
Whether you’re a woman charged with prostitution by undercover cops or a “john” set up by policewomen pretending to be prostitutes, we can help. Years of experience defending against prostitution and solicitation charges guide us in presenting your defense. Frequently the police go too far. Motions to dismiss based on entrapment or outrageous government conduct is our stock in trade. We have that special experience. Back to top
Massage Parlors, Pimping and Pandering
We have extensive experience representing people using the web to make a living. Frequently, legitimate massage parlors or escort services are targeted by law enforcement. We’ve helped many companies and individuals set up a legitimate web site that does not violate the law. If the masseuses are accused of prostituting themselves the owners can be charged with pimping and pandering (i.e. make money off the labor of a prostitute). Call us, we know how to unravel these prosecutions. Back to top
Indecent Exposure
This crime is a serious misdemeanor. The real issue is keeping the person from becoming a registered sex-offender. We use the best psychological evaluations to show there is no need to be tracked as a sex-offender. We’ve had great success in helping people. Back to top
Sexual Battery – Misdemeanor or Felony
Sometimes a simple unwanted touching can result in life changing sex registration. This can happen in a bar, perhaps a doctor brushing up against a co-worker, a nurse (male or female) taking care of a patient or a landlord collecting rent. Frequently these charges are baseless, but, they often are the beginning of a civil law suit. We are experienced at defending these. Back to top
Civil Lawsuits
Defense of a civil lawsuit based on criminal sexual misconduct is something we do. Frequently, a civil lawsuit for big money damages (e.g. a million dollars, or more) is filed against a criminal defendant. Your insurance company will not defend lawsuits based on intentional criminal conduct. You could lose everything. Call us. It is very rare to find any criminal defense firm that will defend civil actions. We do and we have been successful. Back to top
Rights of Victims
There are some important California Code of Civil Procedure statutory rights that victims have. Frequently victims do not want to proceed with the changes for very valid personal reasons, however, the District Attorney will not inform a victim of these rights. Call us, we will explain the rights of both sides of the criminal prosecution. A victim’s rights are often the key to the case. Back to top
